1. About Evaligned

Evaligned ("we", "us", "our") is a self-development platform operated by Evaligned (ABN to be inserted) ("Evaligned"), trading at evaligned.ai. References to "the platform" include the website, web application, AI assessment tools, AI companion features, practitioner directory, membership dashboard, and all associated services.

2. Eligibility and Acceptance

2.1 Age requirement. You must be at least 18 years of age to use this platform. By using the platform — including by completing any assessment — you represent and warrant that you are 18 or older. We require users to confirm their age before accessing any assessment. We do not knowingly permit use by persons under 18 and will terminate any account found to belong to a minor. If you are under 18, you must not use this platform.

2.2 Legal capacity. You represent that you have the legal capacity to enter into a binding agreement and are not barred from doing so under any applicable law.

2.3 Acceptance. Your continued use of the platform following the posting of any changes to these Terms constitutes acceptance of those changes. We will notify registered users of material changes by email or in-platform notice where reasonably practicable.

3. Nature of the Platform — What Evaligned Is and Is Not

3.1 Self-development tool only. Evaligned is a personal self-development and reflection tool. It is designed to help individuals increase self-awareness, identify patterns across life dimensions, and explore potential next steps for personal growth.

3.2 Not medical, clinical, or psychological services. The platform does not provide medical advice, clinical psychology services, psychotherapy, counselling, mental health treatment, or any regulated health service. Nothing on the platform constitutes or should be treated as a clinical assessment, psychiatric evaluation, or health diagnosis. The terms "diagnosis", "pattern", "assessment" and similar are used in a lay, self-reflective sense only and carry no clinical meaning.

3.3 No professional relationship. Use of the platform does not create a therapeutic, counselling, coaching, medical, or any other professional relationship between you and Evaligned or any of its personnel.

3.4 AI-generated content. Portions of the platform, including personalised reports, conversational follow-up questions, and recommended next steps, are generated by artificial intelligence systems (currently OpenAI). AI outputs are probabilistic, may contain errors or inaccuracies, and are not reviewed by a qualified professional before delivery to you. You must not rely on AI-generated content as a substitute for qualified professional advice.

3.5 Individual results vary. Insights, scores, and recommendations generated by the platform are not guarantees of any outcome. Results are based entirely on your own self-reported responses and the limitations of the underlying technology. Evaligned makes no representation that the platform will achieve any particular result for any individual user.

3.6 AI coaching scope.The AI Coach is scoped exclusively to life alignment and wellbeing coaching. It does not answer general knowledge questions, write content, provide financial or legal advice, or perform tasks outside the coaching domain. It uses established coaching frameworks (Motivational Interviewing, Acceptance & Commitment Coaching, Solutions-Focused techniques) and is not a general-purpose AI assistant.

3.7 Automated safety monitoring. All AI interactions are subject to automated safety monitoring. The platform detects signals of potential distress and responds with recommendations for professional support or crisis resources when appropriate. This monitoring operates continuously and cannot be disabled by the user.

3.8 Coaching profile. The platform generates and maintains a coaching profile from your interactions — including identified values, recurring themes, effective practices, and open commitments. This profile is used to improve the personalisation and continuity of AI coaching. It contains thematic summaries, not verbatim conversation records. You may request deletion of your coaching profile at any time.

3.9 Regulatory classification. Evaligned is a general wellbeing and life alignment coaching tool. It is not classified as a medical device under MHRA guidance, and it is not a regulated therapeutic intervention. It does not meet the criteria for Tier 3 of the NICE Evidence Standards Framework for digital health technologies.

4. Mental Health and Crisis Safety

4.1 Crisis situations. This platform is not equipped to respond to mental health crises or emergencies. If you are experiencing thoughts of self-harm, suicide, or harm to others, or if you are in immediate danger, you must contact emergency services immediately.

4.2 Professional support. If the platform's output indicates that deeper or professional support may be appropriate, we strongly encourage you to act on that recommendation. The platform's suggestion to seek professional support is not a clinical referral and does not carry clinical weight, but it is offered in good faith and should be taken seriously.

5. Accounts and Registration

5.1 To access certain features you must create an account. You agree to provide accurate, current, and complete information during registration and to keep that information updated.

5.2 You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials. You must notify us immediately at legal@evaligned.ai if you suspect any unauthorised use of your account.

5.3 You may not create an account on behalf of another person without their knowledge or consent.

6. Subscriptions, Payments and Refunds

6.1 Subscription terms. Paid features are offered on a recurring subscription basis. Subscription fees are billed in advance for the applicable period (monthly or annual) and are non-refundable except as required by applicable consumer protection law.

6.2 Cancellation. You may cancel your subscription at any time through your account dashboard or by contacting us. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.

6.3 Price changes. We reserve the right to change subscription pricing with at least 30 days' prior notice to registered subscribers. Continued use of a paid subscription after the price change takes effect constitutes your acceptance of the new pricing.

6.4 Free features. Certain features, including the initial assessment and AI report, are offered free of charge. We reserve the right to modify, restrict, or withdraw free features at any time without liability.

6.5 Australian Consumer Law. Where you are a consumer under the Australian Consumer Law ("ACL"), you may have statutory rights and guarantees that cannot be excluded, restricted, or modified. Nothing in these Terms excludes, restricts, or modifies any right, guarantee, or warranty implied by the ACL or any other applicable consumer protection legislation that cannot lawfully be excluded. Where the ACL permits us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited to (at our option) re-supplying the services or paying the cost of re-supplying the services.

7. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable law or regulation;
• Attempt to gain unauthorised access to any part of the platform or its underlying systems;
• Reverse-engineer, decompile, scrape, or extract any content, data, algorithms, or AI model weights from the platform;
• Submit false, misleading, or fraudulent information;
• Use the platform to harm, harass, defame, or intimidate any person;
• Transmit any virus, malware, or disruptive code;
• Use automated tools to access, query, or scrape the platform without written consent;
• Resell, sublicense, or commercially exploit any part of the platform without our written consent;
• Use the platform in any way that could damage its reputation or operations.

8. Practitioner Listings

8.1 Independence. Practitioners listed on the Evaligned platform are independent professionals. They are not employees, agents, or contractors of Evaligned. Evaligned does not supervise, endorse, or warrant the services, qualifications, conduct, or advice of any listed practitioner.

8.2 No liability for practitioner services. Evaligned accepts no responsibility or liability for any services provided by practitioners, any advice given, any harm caused, or any outcome resulting from your engagement with any practitioner, whether found through the platform or otherwise.

8.3 Referral only. Any platform recommendation to engage a practitioner is a suggestion based on self-reported assessment data and is not a clinical referral, medical referral, or regulated health recommendation.

9. Intellectual Property

9.1 All content, materials, brand elements, methodology frameworks, archetype systems, algorithms, and platform design are the intellectual property of Evaligned and are protected by copyright, trade mark, and other applicable intellectual property laws. The Evaligned Model™ methodology is a proprietary framework owned exclusively by Evaligned.

9.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the platform solely for your own personal, non-commercial purposes in accordance with these Terms.

9.3 Your content. You retain ownership of any personal responses, text, or information you submit to the platform. By submitting content, you grant Evaligned a non-exclusive, worldwide, royalty-free licence to use, process, and analyse that content for the purpose of providing services to you and, in anonymised and aggregated form, for platform improvement, research, and methodology development. We will not use your individually identifiable responses in any public-facing context without your explicit consent.

10. Third-Party Services

The platform integrates with third-party technology providers including but not limited to OpenAI (AI content generation), Supabase (data storage), Vercel (hosting), and Resend (email delivery). Use of the platform is subject to the terms and privacy policies of these providers. Evaligned is not responsible for the conduct, availability, or terms of any third-party service. Links to third-party websites are provided for convenience only and do not constitute endorsement.

11. Disclaimer of Warranties

11.1 To the maximum extent permitted by applicable law, the platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We expressly disclaim all implied warranties including but not limited to merchantability, fitness for a particular purpose, accuracy, completeness, reliability, and non-infringement.

11.2 We do not warrant that the platform will be uninterrupted, error-free, secure, or free from viruses or harmful components. We do not warrant that any AI-generated output is accurate, complete, appropriate, or suitable for any purpose.

11.3 Nothing in this clause excludes any warranty or guarantee implied by consumer protection legislation that cannot lawfully be excluded, including under the Australian Consumer Law.

12. Limitation of Liability

12.1 To the maximum extent permitted by law, Evaligned, its directors, officers, employees, contractors, and agents will not be liable to you for any:

• Indirect, incidental, consequential, special, or punitive damages;
• Loss of profits, revenue, data, goodwill, or business opportunities;
• Personal injury or psychological harm arising from use of or reliance on platform content or AI outputs;
• Decisions made, actions taken, or actions not taken in reliance on the platform;
• Outcomes of engagements with practitioners referred or listed on the platform;
• Loss or damage arising from third-party service outages, data breaches, or conduct.

12.2 Aggregate cap. To the extent Evaligned has any liability to you that cannot be excluded under applicable law, our total aggregate liability to you arising out of or in connection with the platform and these Terms will not exceed the greater of: (a) the total subscription fees paid by you to Evaligned in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) AUD $100.

12.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be lawfully excluded.

12.4 Australian Consumer Law. If you are a consumer under the ACL, certain statutory guarantees apply and our liability is subject to, and limited as provided under, the ACL. Nothing in these Terms is intended to exclude, restrict, or modify those rights to the extent they cannot lawfully be excluded.

13. Indemnification

You agree to indemnify, defend, and hold harmless Evaligned and its directors, officers, employees, contractors, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of or access to the platform; (b) your breach of these Terms; (c) your violation of any applicable law; (d) any content you submit to the platform; or (e) your reliance on or misuse of any AI-generated output.

14. Termination

14.1 We reserve the right to suspend or terminate your access to the platform at any time, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent or unlawful conduct, or for any other reason at our sole discretion.

14.2 You may delete your account at any time through your account settings. Deletion of your account constitutes termination of these Terms except for provisions that by their nature survive termination (including Sections 9, 11, 12, 13, 15, and 16).

15. Governing Law and Dispute Resolution

15.1 Governing law. These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of laws principles.

15.2 Jurisdiction. You submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia. Nothing in this clause prevents Evaligned from seeking urgent injunctive relief in any appropriate jurisdiction.

15.3 International users. If you access the platform from outside Australia, you do so on your own initiative and are responsible for compliance with all applicable local laws. Evaligned makes no representation that the platform or its content is appropriate or available for use in any particular jurisdiction.

15.4 Informal resolution. Before initiating formal proceedings, we encourage you to contact us at legal@evaligned.ai to attempt to resolve any dispute informally.

16. General Provisions

16.1 Entire agreement. These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Aligned Self with respect to the platform and supersede all prior understandings, representations, and agreements.

16.2 Severability. If any provision of these Terms is held unlawful, invalid, or unenforceable by a court of competent jurisdiction, that provision will be deemed severed and the remaining provisions will continue in full force.

16.3 No waiver. Failure by Evaligned to enforce any provision of these Terms does not constitute a waiver of that provision or of the right to enforce it subsequently.

16.4 Assignment. You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.

16.5 Updates. We may update these Terms at any time by posting the revised version on this page with an updated effective date. Your continued use of the platform after the effective date constitutes acceptance of the revised Terms.
